The items described in this document are hereby offered for sale by Walker Engineering, its subsidiaries, or its authorized distributors.
WALKER ENGINEERING WARRANTIES STATEMENT
Seller's Warranties. Seller warrants that the equipment to be delivered will be free from defects in material or workmanship, and will be of the kind and quality designated or specified in the contract. This warranty shall apply only to defects appearing within one (1) year from the date of shipment by the Seller, unless a different warranty period is specified by Seller. If Seller installs the equipment or supplies technical direction or installation by contract, the warranty period shall run from the completion of installation, provided same is not unreasonably delayed by the Purchaser. If the equipment delivered hereunder does not meet the above warranty, and if the Purchaser promptly notifies Seller, the Seller shall thereupon correct any defect, including non-conformance with specifications, either (at its option) by repairing any defective or damaged parts or the equipment, or by making available at the Seller's plant necessary repaired or replacement parts. The liability of Seller under this warranty, for any loss or damage to the equipment whether the claim is based on contract or negligence, shall not in any case exceed the cost of correcting defects in the equipment as herein provided and, upon the expiration of the warranty period, all such liability shall terminate. The foregoing shall constitute the exclusive remedy of the Purchaser and the exclusive liability of the Seller. THE EXPRESSED WARRANTY SET FORTH IS A LIMITED WARRANTY AND IT IS THE ONLY WARRANTY MADE BY SELLER. SELLER MAKES AND PURCHASER RECEIVES NO OTHER EXPRESSED WARRANTY AND NO IMPLIED WARRANTIES. ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY EXCLUDED. THE STATED EXPRESSED WARRANTY IS IN LIEU OF ALL LIABILITIES OR OBLIGATIONS OF SELLER FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SALE, DELIVERY, OPERATION OR USE OF THE GOODS.
Voiding of Warranty. The warranties set forth herein shall be void if the goods have been (1) repaired or altered outside of Seller's facilities, (2) subjected to misuse, negligence, accident, or operated in other than normal and proper use and service, or (3) connected, installed, or adjusted in a manner not in accordance with Seller's instructions.
Non-Consequential Damages. In no event shall Seller have any liability for any direct consequential exemplary, special or incidental damages resulting from the sale, delivery, operation, or use of the goods herein. This limitation on liability shall be applicable irrespective of the theory relied upon for the assertion of any claim for damages (whether breach of contract, breach of warranty, negligence, strict liability, or otherwise).

This document and other information from Walker Engineering, its subsidiaries, and authorized distributors provide product and/or system options for further investigation by users having technical expertise. It is important that you analyze all aspects of your application and review the information concerning the product or system in the current product catalog. Due to the variety of operating conditions and applications for these products or systems, the user, through its own analysis and testing, is solely responsible for making the final selection of the products and systems and assuring that all performance, safety and warning requirements of the applications are met. The products described herein, including with limitation, product features, specifications, designs, availability, and pricing, are subject to change by Walker Engineering or its subsidiaries at any time, without notice.
